BY SIGNING AND RETURNING A PLEA IN ABSENTIA, THE DEFENDANT DOES:
  1. Plead no contest and admit the charge(s) against them.
  2. All defenses to the charge are waived, including any right to a speedy trial.
  3. Accepting this plea may result in a record showing a misdemeanor in the Bay County Courts.
  4. The defendant loses any right to a jury trial and the service of any attorney.
  5. The Court may or may not grant the defendant probation.
  6. The defendant loses any right to remain silent, and the presumption of innocence.
  7. The defendant loses any right to confront witnesses against them or have witnesses testify for them.
  8. The County Court records will reflect this plea was voluntarily made and that the defendant fully understood the consequences and was not motivated by threats or coercion.
  9. The defendant will enclose the sum posted on each plea.
  10. By accepting this plea the defendant is hereby found to be guilty of the charges against them and the following sentence is imposed:
    COURT COST / FINE OF $417.00 AND ADJUDICATION WITHHELD FOR EACH PLEA.
The signed and witnessed Plea in Absentia must be received in this office, with full payment, within 60 days from the date the citation was issued. If you fail to return the Plea and full payment within 60 days, a capias will be issued for your arrest. If payment is made online with a credit card, the Plea must be received within 60 days or the payment will be refunded and a capias will be issued for your arrest.

Please send to this office TWO SIGNED AND WITNESSED COPIES of the Plea in Absentia with a money order or cashiers check made payable to BILL KINSAUL, CLERK OF COURT or link to the online payment to pay by credit card now. EVEN IF PAYMENT IS MADE ONLINE, TWO SIGNED AND WITNESSED COPIES OF EACH PLEA MUST BE RECEIVED IN THIS OFFICE WITHIN 60 DAYS. TO EXPEDIATE PAYMENT OF THIS FINE, YOU MAY FAX TO (850) 747 - 5188, HOWERVER, WE MUST RECEIVE THE ORIGINAL SIGNED COPIES FOR THE JUDGE WITHIN 60 DAYS, OR A WARRANT/CAPIAS WILL BE ISSUED FOR YOUR ARREST. Failure to return this Plea in Absentia with a cashiers check, money order or payment by credit card, will result in issuance of a capias/warrant for your arrest. All Plea in Absentias listed below have a fine of $417.00.

  6. MISREPRESENTATION OF AGE BY A MINOR TO OBTAIN ALCOHOL
  7. POSSESSION OF ALCOHOL BY MINOR / POSSESSION OF ALCOHOL BY MINOR IN PARK
